Wouldn't disputing them with facts work better?

As Mr. Harris points out, that isn't the tactic democrats are taking.
Perhaps because the facts (i.e. the truth) isn't on their side.
There is an old saying the legal community.
When the facts are on your side, argue the facts.
If the facts are not on your side, argue the law.
If the facts and the law are not on your side, pound the table and shout.
Both Kerry & Edwards are lawyers. They are both pounding the table and shouting.
